Copyright protection for the healthy development of the cultural industry

The digital environment poses many challenges in protecting the rights of subjects and the activities of management and enforcement agencies on copyright and related rights.

On the morning of April 17, in Hanoi, the Copyright Office (Ministry of Culture, Sports and Tourism) chaired and coordinated with the Vietnam Digital Media Association and the Digital Content Creation Alliance to organize a discussion ” Copyright and Sustainable Development of the Digital Content Creation Industry” with the participation of more than 200 delegates.

At the seminar, Director of the Copyright Office Tran Hoang stated: Vietnam’s cultural industries have made new developments in terms of art, technology and ways to reach the public. The commercial aspect of cultural industries is also focused on investment and development. Doing a good job of copyright protection is an important factor in building a healthy, competitive cultural industry; Contributing more and more to GDP, creating more jobs and increasing the country’s export turnover.

Data published in 2021 by the World Intellectual Property Organization (WIPO) on the economic contribution of cultural industries based on copyright, in the United States accounts for about 11.99% of GDP, South Korea 9, 89%, France 7.02%, Australia 6.8%, Singapore 6.19%, Canada 6.15% of GDP. In Asia, in China it is about 7.35% of GDP, Malaysia 5.7%, Thailand 4.48%, Indonesia 4.11%. This shows that effective copyright protection plays an important role, contributing to the economic, cultural and social development of each country.

In Vietnam, it is estimated that the added value (current price) of cultural industries contributing to the economy is estimated to reach 5.82% in 2018; in 2019 it was 6.02%. In 2020-2021, due to the impact of COVID-19, there is a decrease, only about 4.32% and 3.92%; By 2022, the industries have begun to recover, with an estimated growth of 4.04%. The production value of Vietnam’s cultural industries in the period 2018-2022 is estimated to contribute an average of 1,059 million billion VND (equivalent to about 44 billion USD).

To strengthen the management and enforcement of copyright and related rights in the digital environment, Vietnam has become a member of the WCT Treaty from February 17, 2022 and a member of the WPPT Treaty from February 1. /7/2022. At the same time, the Law amending and supplementing a number of articles of the Intellectual Property Law, effective from January 1, 2023, has many new regulations on content related to copyright protection and related rights. in digital environment. The Ministry of Culture, Sports and Tourism has actively coordinated with the Ministry of Information and Communications in implementing digital transformation and enforcing copyright and related rights protection in the digital environment.
